IT project and technical specification examination

Technical analysis of a dispute over IT system development, implementation or modification: contract, technical and detailed technical specifications, stages, acceptance certificates, correspondence and actual deliverable. Fees from RUB 120,000. Moscow and the Moscow Region.

When it is needed

Technical analysis of a dispute over IT system development, implementation or modification: contract, technical and detailed technical specifications, stages, acceptance certificates, correspondence and actual deliverable. Such an examination may be needed for court proceedings, a formal claim, negotiations, internal quality checks, work acceptance or assessment of a technical position before a dispute.

What is examined

  • comparison of requirements and deliverable
  • identification of work outside the specifications or unmet requirements
  • technical position for a formal claim, negotiations or court proceedings
  • contract, technical specifications, detailed technical specifications, annexes, correspondence, acceptance certificates, screenshots and other materials;
  • the connection between identified defects and the parties' actions, operation, infrastructure or technical conditions.

Sample questions

  • Does the object meet the requirements of the contract, technical specifications, detailed technical specifications or technical documentation?
  • Are there technical indicators of the alleged shortcomings or nonconformities?
  • What are the possible causes of the failures, defects or discrepancies identified?
  • Are the materials provided sufficient for a technical conclusion?

What matters most in IT disputes

In development and implementation disputes, legal and technical assessments must be distinguished. Technical work generally involves comparing requirements, the actual deliverable, acceptance criteria, test records, logs, architecture, correspondence and the parties' actions.

Result

The result may be a specialist opinion, technical memorandum, review, list of acceptance comments or preliminary position for an application to the court.

Linking requirements to the delivered project version

An IT project dispute is easier to analyze by individual deliverable: a function, integration, report, module or completed stage. For each, identify the requirement, relevant document version and software version submitted for checking. This enables discussion of a specific discrepancy even where the contract's general wording covers an extensive body of work.

Working table of disagreements

  1. Clause number and document recording the requirement; version date and related change.
  2. Build, branch or repository snapshot examined, and details of when that version was delivered.
  3. Expected system action and observed result with specified input data.
  4. Materials allowing the result to be checked: log, API response, report file, scenario video or test record.
  5. The question remaining in dispute after comparing documents and technical data.

If a requirement was clarified in correspondence, preserve the whole discussion with attachments. An isolated phrase may concern another stage or condition. A technical examination can establish which function a version implements and how it operates; the legal significance of agreeing changes is assessed separately.

Record the working system copy and original materials before fixing the defect. Subsequent modification shows a new project state. It helps check that the problem has been resolved but does not replace information about the original deliverable.
