Pre-litigation specialist opinion on IT issues

Pre-litigation specialist opinion on software, websites, applications, databases, logs, digital materials and technical devices.

When a specialist opinion is needed

A pre-litigation specialist opinion helps record technical circumstances before going to court, prepare a substantiated formal claim, assess completed work quality and determine which evidence must be preserved.

What can be examined

  • software, a website or mobile application;
  • compliance of the deliverable with the contract and technical and detailed technical specifications;
  • system failures, logs, databases and user actions;
  • electronic correspondence, files, metadata and screenshots;
  • computers, servers, storage devices, electronics and office equipment.

What it is used for

  • preparing a formal claim against a developer or contractor;
  • substantiating a refusal to accept work or a demand to remedy shortcomings;
  • assessing a technical position before litigation;
  • preparing questions for a subsequent court-appointed examination;
  • negotiations and internal investigations.

Materials required

The materials depend on the task. A contract, technical specifications, acceptance certificates, correspondence, links, screenshots, exports, logs and access to a test environment or the device being examined are usually required. Original files should preferably be preserved without renaming or changing their dates.

Result

A specialist opinion is prepared describing the initial data, analysis performed, indicators identified, examination limitations and technically substantiated conclusions.
